What is an Export Management Compliance Program?

Answer: Both the operational export compliance policies and procedures an organization implements and a written set of guidelines that captures those policies and procedures. An effective EMCP answers the Why, What, Where, When, How, and By Whom your company export policies and procedures are to be implemented.

Does our company need to have an EMCP?

Answer: While technically not required under the U.S. Export Administration Regulations, having an internal export compliance program and manual in place is highly recommended and it is given “great weight” in mitigating fines and penalties by BIS in export enforcement cases. An effective EMCP will help ensure that the correct export decisions are consistently being made; that employees know their export control responsibilities; that the right procedures are being followed; and that the right questions are being asked to ensure that exports are being made in compliance with the U.S. Export Administration Regulations.

The training is driven by a proprietary 47 PowerPoint slide presentation that is based on the recommendations and guidelines for creation of an EMCP that are made by the U.S. Department of Commerce, Bureau of Industry and Security. The module reviews, in technical detail, the various templates and key components suggested in the Guidelines offered by BIS for structuring a company specific internal export compliance manual. The module also provides an overview of BIS’s self-audit module and we provide recommendations on how to implement an effective compliance self-audit. We can present the training either in person at your company or as a webinar using live online audio/visual technology which brings TSI Global Consulting into your conference room. The presentation runs approximately 3.5 hours with Q&A.
