
On November 26th the Bureau of Industry and Security (BIS) issued a final rule expanding export controls and licensing requirements for export, re-export or transfer to/with Pakistan as applied to a handful of items of specific concerns surrounding diversion to unauthorized end users/uses. Products falling under Export Control Classification Number (ECCN) 1B999, 2A992, 2B999 (other than 2B999.h.2), 3A992, 3A999 and 6A996 which were prior to this final rule No License Required will now require licenses for Pakistan. The only license exceptions that are now available for the export, re-export or transfer of these items to/within Pakistan are TMP (limited to 740.9(a)(1), (a)(4), (a)(5), (a)(10), (b)(2), and (b)(3)), RPL (740.10), and GOV (limited to 740.11(a), (b), and (d)). The items falling under these new licensing requirements for Pakistan fall into the following broad categories:
- Particle accelerators
- Certain stainless or alloy pipes and valves
- Certain pumps and welders
- Oscilloscopes
- Chromatographs and spectrometers
- Magnetometers
